
TERMS AND CONDITIONS – TRASIDO MARKETPLACE
These Terms and Conditions (“Terms”) govern access to and use of the Trasido platform, website, applications, and related services (collectively, the “Platform”).
By accessing or using the Platform, users agree to be bound by these Terms.
1. Platform Operator
The Trasido marketplace platform, including its website, applications, digital interfaces, payment infrastructure, and related services (collectively, the "Platform"), is owned, operated, and administered by AC/DC d.o.o., Partizanska cesta 14, 2230 Lenart, Republic of Slovenia, contactable via e-mail at info@ac-dc.org.
AC/DC d.o.o. acts as the sole legal operator and service provider of the Platform and is responsible for its technical operation, maintenance, commercial management, payment infrastructure administration, and regulatory compliance in accordance with applicable European Union and Slovenian legislation, including but not limited to legislation governing electronic commerce, consumer protection, digital services, payment services, and data protection.
Unless expressly stated otherwise for specific transactions, AC/DC d.o.o. acts as the contracting entity in relation to the provision of Platform services and, where payments are processed through Platform-operated payment infrastructure, acts as the merchant of record for such transactions. The allocation of responsibility for individual product sales between AC/DC d.o.o. and independent sellers is further defined in Section 2 of these Terms.
AC/DC d.o.o. operates the Platform as an intermediary information society service provider within the meaning of Regulation (EU) 2022/2065 (Digital Services Act). In this capacity, AC/DC d.o.o. provides the technical environment enabling interactions between users and does not assume a general obligation to monitor user activity, listings, or content, except where required under applicable law.
The Platform may be operated within a broader corporate ownership or strategic cooperation framework. In this context, AC/DC d.o.o. maintains an ownership and strategic cooperation relationship with Project Leadership Solutions FZE, TAX ID 104417156700001, registered at Business Centre, Sharjah Publishing City Free Zone, Sharjah, United Arab Emirates.
Such ownership, investment, or strategic arrangements exist exclusively at the corporate and investment level and do not establish any contractual, service, agency, partnership, joint venture, or fiduciary relationship between Platform users and Project Leadership Solutions FZE, unless expressly stated in writing for a specific service or transaction.
For the purposes of these Terms and all contractual relationships arising from the use of the Platform, AC/DC d.o.o. remains the sole entity responsible for the operation and administration of the Platform, the provision of Platform services, and compliance with applicable legal and regulatory obligations. Where products or services are offered directly under the Trasido brand or by AC/DC d.o.o., AC/DC d.o.o. acts as the contracting party and assumes the legal responsibilities of the seller or service provider in accordance with applicable law.
The role, responsibilities, and liability of AC/DC d.o.o. as Platform operator are further defined and limited by the allocation of responsibilities and limitation of liability provisions set out in these Terms.
2. Nature of the Platform and Sales Structure
Trasido operates as an online digital marketplace designed to facilitate commercial transactions between buyers and independent third-party sellers. The Platform provides technical infrastructure, communication tools, and transactional support that enable sellers to present, market, and sell products or services to buyers through the Platform interface.
Unless expressly stated otherwise, AC/DC d.o.o. acts as the contracting entity responsible for the administration and commercial operation of the Platform, including the coordination of payment processing arrangements through integrated third-party payment service providers. Any ownership or strategic partnership arrangements maintained by AC/DC d.o.o. do not affect or modify the allocation of legal responsibilities established under these Terms.
In transactions involving products or services offered by independent sellers, AC/DC d.o.o. acts solely as a provider of the technical environment that enables such transactions to take place. Unless explicitly stated otherwise, AC/DC d.o.o. does not act as the seller, supplier, distributor, or contractual party in transactions concluded between buyers and independent sellers. Contracts relating to the purchase of products or services listed by independent sellers are concluded directly between the buyer and the respective seller, who remains solely responsible for compliance with all applicable legal and regulatory requirements. Such responsibilities include, but are not limited to, obligations relating to product conformity, consumer protection, delivery performance, warranties, licensing rights, taxation, and post-sale support.
In addition to its role as a marketplace operator, Trasido may, in certain circumstances, offer products or services directly under its own brand, commercial identity, or business operations. Where products or services are explicitly identified as being sold by Trasido or by AC/DC d.o.o., AC/DC d.o.o. acts as the legal seller or service provider and assumes all obligations imposed on sellers under applicable European Union and Slovenian legislation. This includes compliance with consumer protection requirements, statutory warranty obligations, withdrawal rights, conformity requirements for goods and digital content, and any other mandatory legal protections afforded to consumers. Products or services sold directly by Trasido are clearly identified on the Platform in order to ensure transparency and regulatory compliance.
Where the Platform provides digital content, software, electronically supplied services, or other forms of digital products directly through Trasido, AC/DC d.o.o. ensures compliance with applicable legislation governing digital content and digital services, including Directive (EU) 2019/770, as well as other relevant European and Slovenian consumer protection legislation. Such compliance includes requirements relating to lawful distribution, technical functionality, compatibility, accessibility, and consumer rights applicable to electronically supplied content.
The Platform operates under a dual commercial structure in which independent sellers remain fully responsible for transactions conducted through their own listings, while AC/DC d.o.o. assumes legal responsibility only for products or services explicitly identified as being supplied directly by Trasido. In order to ensure user transparency and regulatory compliance, the Platform clearly identifies the responsible seller or supplier for each product or service listing. This approach is designed to comply with applicable European consumer protection legislation, including Directive 2011/83/EU on consumer rights, Directive (EU) 2019/770 concerning digital content and digital services, Directive (EU) 2019/771 concerning contracts for the sale of goods, Regulation (EU) 2022/2065 (Digital Services Act), and applicable Slovenian consumer protection legislation.
Where payments are processed through Platform-operated payment infrastructure, AC/DC d.o.o. may act as merchant of record or payment facilitator solely for technical and administrative purposes, unless expressly stated otherwise for specific transactions.
2.1 Marketplace Function
In its primary function, the Platform operates as an intermediary digital marketplace that enables independent third-party sellers to present, advertise, and offer products or services to buyers through the Platform interface. The Platform provides technological infrastructure, communication tools, and transactional support designed to facilitate commercial interactions between users in a secure and structured digital environment.
Where products or services are offered by independent sellers, AC/DC d.o.o. does not act as the seller, supplier, distributor, or contractual party to transactions concluded between buyers and sellers. The role of AC/DC d.o.o. is limited to providing and maintaining the technical environment in which such transactions may be initiated, conducted, and completed. Consequently, purchase agreements relating to products or services offered by independent sellers are concluded exclusively between the buyer and the respective seller.
Independent sellers remain solely responsible for ensuring that their listings and commercial activities conducted through the Platform comply with all applicable legal and regulatory requirements. This responsibility includes, but is not limited to, obligations relating to product safety, product conformity, licensing rights, intellectual property compliance, consumer protection regulations, delivery performance, warranties, taxation, and after-sales services.
AC/DC d.o.o. does not verify, endorse, or guarantee the accuracy, legality, quality, safety, availability, or conformity of products or services offered by independent sellers and does not assume responsibility for the performance or non-performance of contractual obligations by buyers or sellers.
The Platform may provide communication channels, payment processing support, order management tools, and dispute reporting mechanisms in order to facilitate user interaction and transaction processing. Such functionalities are provided solely to support the operation of the marketplace and shall not be interpreted as establishing AC/DC d.o.o. as a party to the contractual relationship between buyers and independent sellers. Unless required by applicable law, AC/DC d.o.o. does not assume responsibility for mediating, supervising, or resolving disputes arising between users.
AC/DC d.o.o. operates the Platform as a neutral technical intermediary and, in accordance with applicable legislation, does not assume a general obligation to monitor user activity, listings, or transactions conducted through the Platform. Notwithstanding the foregoing, AC/DC d.o.o. reserves the right to implement reasonable measures to maintain Platform integrity, comply with legal obligations, prevent unlawful activity, and protect users and third parties, including restricting access to listings or user accounts where reasonably necessary.
Independent sellers are solely responsible for compliance with applicable product safety, import, certification, labelling, and regulatory requirements, including obligations arising under European product safety and market surveillance legislation.
2.2 Direct Sales by Trasido
In addition to its role as a marketplace operator, the Platform may, in certain circumstances, offer products or services directly under the Trasido brand or through the commercial activities of AC/DC d.o.o. In such cases, AC/DC d.o.o. acts as the legal seller or service provider and enters into a direct contractual relationship with the buyer.
Where products or services are sold directly by Trasido, AC/DC d.o.o. assumes all obligations imposed on sellers under applicable European Union and Slovenian legislation. This includes, without limitation, obligations relating to consumer protection, statutory warranties, conformity of goods and digital content, withdrawal rights, product safety requirements, and any other mandatory consumer rights. Such obligations are fulfilled in accordance with Directive 2011/83/EU on consumer rights, Directive (EU) 2019/770 concerning digital content and digital services, Directive (EU) 2019/771 concerning contracts for the sale of goods, and applicable Slovenian consumer protection legislation.
Products or services sold directly by Trasido shall be clearly identified on the Platform as being supplied by AC/DC d.o.o. in order to ensure transparency and to enable buyers to distinguish between products offered by independent sellers and those offered directly by the Platform operator. The applicable contractual terms, return conditions, warranty obligations, delivery arrangements, and after-sales support applicable to such products or services shall be determined by AC/DC d.o.o. and made available to buyers prior to the conclusion of the contract.
Where Trasido provides digital products, software, downloadable content, electronically supplied services, or other forms of digital content, AC/DC d.o.o. ensures that such offerings comply with applicable legislation governing digital content and digital services. This includes requirements relating to lawful distribution, technical functionality, compatibility, accessibility, security, and consumer rights applicable to digital purchases. Any licensing terms, permitted usage rights, or technical restrictions applicable to digital products offered directly by Trasido shall be clearly communicated to buyers prior to purchase and shall form part of the contractual relationship.
The operation of the Platform under this dual commercial model does not affect the allocation of responsibility for transactions conducted by independent sellers. Independent sellers remain solely responsible for their own listings and transactions, while AC/DC d.o.o. assumes responsibility only for products or services explicitly identified as being sold directly by Trasido.
2.3 Digital Products Sold by Trasido
Where Trasido offers digital content, software, downloadable materials, electronically supplied services, or other forms of digital products directly through the Platform, AC/DC d.o.o. acts as the legal supplier of such digital content and enters into a direct contractual relationship with the buyer.
AC/DC d.o.o. ensures that digital products offered directly by Trasido comply with applicable European Union legislation governing digital content and digital services, including Directive (EU) 2019/770, as well as applicable Slovenian consumer protection legislation. Digital products are supplied in accordance with contractual specifications relating to functionality, compatibility, interoperability, accessibility, and security, taking into account the nature of the digital product, technical limitations, and reasonable consumer expectations.
Where permitted by applicable law, the delivery or activation of digital content may commence immediately after purchase, provided that the buyer has given prior express consent to the commencement of performance before the expiry of the statutory withdrawal period and has acknowledged that such consent may result in the loss of the right to withdraw from the contract. Where such consent is required by law, the Platform shall obtain and record such consent prior to providing access to digital content.
Digital products supplied by Trasido may be subject to licensing terms, usage restrictions, or access limitations. Any applicable licensing conditions, permitted usage rights, intellectual property limitations, or technical restrictions shall be clearly communicated to buyers prior to purchase and shall form an integral part of the contractual relationship. Buyers are responsible for ensuring that their devices, software environment, and technical capabilities are compatible with the digital products prior to purchase.
AC/DC d.o.o. reserves the right to implement proportionate technical protection measures designed to prevent unauthorised reproduction, distribution, resale, or misuse of digital content. Such measures may include authentication controls, access verification mechanisms, download or usage limitations, licence validation tools, or other technical safeguards consistent with applicable law and industry standards.
The provision of digital products by Trasido does not affect the allocation of responsibility for digital content offered by independent sellers through the Platform. Independent sellers remain solely responsible for compliance with applicable legal and regulatory requirements relating to digital content offered through their own listings, while AC/DC d.o.o. assumes responsibility only for digital products explicitly identified as being supplied directly by Trasido.
2.4 Allocation of Responsibilities
The Platform operates under a dual commercial structure in which transactions may be conducted either through independent third-party sellers or directly by Trasido. In order to ensure transparency, legal certainty, and compliance with applicable regulatory requirements, the Platform clearly identifies the supplier responsible for each product or service listing.
Where products or services are offered by independent sellers, such sellers remain solely and fully responsible for all aspects of their commercial activities conducted through the Platform. This responsibility includes, but is not limited to, compliance with applicable product safety requirements, product conformity standards, intellectual property rights, licensing obligations, consumer protection laws, taxation obligations, delivery performance, warranty obligations, product information accuracy, and post-sale customer support. In such cases, the contractual relationship governing the purchase of products or services is established directly between the buyer and the independent seller, and AC/DC d.o.o. does not assume responsibility for the performance or non-performance of obligations arising from such contractual relationships.
Where products or services are explicitly identified as being offered by Trasido or by AC/DC d.o.o., AC/DC d.o.o. assumes responsibility as the legal seller or service provider and fulfils all obligations imposed by applicable European Union and Slovenian legislation governing consumer contracts. This includes statutory warranty obligations, product conformity requirements, withdrawal rights, digital content compliance obligations, and any other mandatory consumer protection rights applicable under relevant legislation.
The Platform implements measures designed to ensure that users are able to identify the responsible supplier prior to concluding a transaction. Such measures include clear identification of the seller or service provider within product listings and during the purchasing process, in accordance with applicable European consumer protection legislation, including Directive 2011/83/EU on consumer rights, Directive (EU) 2019/770 concerning digital content and digital services, Directive (EU) 2019/771 concerning contracts for the sale of goods, Regulation (EU) 2022/2065 (Digital Services Act), and applicable Slovenian consumer protection legislation.
Nothing in the operation of the Platform shall be interpreted as creating a partnership, agency relationship, joint commercial undertaking, or joint liability between AC/DC d.o.o. and independent sellers. Each seller operates independently and bears sole responsibility for compliance with all legal and regulatory obligations arising from their commercial activities conducted through the Platform.
AC/DC d.o.o. provides the Platform as a technological and commercial infrastructure enabling interactions between users and shall not be liable for acts, omissions, or legal violations committed by independent sellers or buyers, except where liability arises directly from AC/DC d.o.o.'s own activities as a seller or service provider or where liability cannot be excluded under mandatory applicable law.
2.5 Consumer Transparency and Legal Compliance
Trasido is committed to ensuring a high level of transparency and consumer protection in accordance with applicable European Union and Slovenian legislation governing digital marketplaces and distance selling. Prior to the conclusion of any transaction conducted through the Platform, buyers are provided with clear, accurate, and comprehensible information regarding the identity of the supplier responsible for the product or service, including whether such supplier is an independent third-party seller or AC/DC d.o.o. acting under the Trasido brand.
The Platform ensures that essential pre-contractual information required under Directive 2011/83/EU on consumer rights and applicable Slovenian consumer protection legislation is made available to buyers in a clear and accessible manner. Such information includes, where applicable, the main characteristics of the product or service, total pricing including applicable taxes and charges, delivery terms, applicable withdrawal rights, warranty conditions, licensing restrictions, and the duration and nature of contractual obligations.
In accordance with Regulation (EU) 2022/2065 (Digital Services Act), the Platform implements reasonable and proportionate measures designed to ensure that users can clearly identify commercial communications, sponsored content, and promotional listings. The Platform also ensures that users are able to distinguish between products or services offered by independent sellers and those offered directly by AC/DC d.o.o.
Trasido maintains internal procedures designed to address notices relating to illegal content, unlawful products, intellectual property infringements, or regulatory violations, in accordance with applicable notice-and-action requirements under the Digital Services Act. While AC/DC d.o.o. does not assume a general obligation to monitor user activity, it may take reasonable measures to restrict access to listings, suspend transactions, or remove content where required to comply with legal obligations, protect users, or maintain the integrity and lawful operation of the Platform.
The transparency measures implemented by Trasido are intended to support informed consumer decision-making and to ensure compliance with applicable regulatory requirements. Nothing in this section shall be interpreted as extending the legal responsibility of AC/DC d.o.o. beyond obligations imposed under applicable law or as creating liability for products or services offered by independent sellers where AC/DC d.o.o. does not act as the legal supplier.
3. Eligibility and Account Registration
Access to and use of the Platform is permitted only to individuals and legal entities that have the legal capacity to enter into binding contracts under applicable law. By creating an account or using the Platform, users represent and warrant that they are at least eighteen (18) years of age or otherwise legally authorised to enter into contractual relationships and to use digital marketplace services.
Users further represent and warrant that they are not subject to any legal restrictions, international sanctions, export control regulations, or other regulatory prohibitions that would prevent them from using the Platform under applicable European Union, Slovenian, or international law.
In order to access certain features or functionalities of the Platform, users may be required to create an account and provide accurate, complete, and up-to-date information during the registration process. Users are responsible for ensuring that all information provided during registration and throughout the use of the Platform remains truthful, current, and not misleading. AC/DC d.o.o. reserves the right to request additional information, documentation, or verification where reasonably necessary to comply with legal obligations, including obligations relating to consumer protection, fraud prevention, anti-money laundering requirements, Know-Your-Customer (KYC) or Know-Your-Business (KYB) verification, regulatory compliance, or Platform security.
Users may not create multiple accounts, impersonate other individuals or legal entities, provide false identity or business information, or transfer, sell, or otherwise grant access to their account credentials to third parties without the prior written consent of AC/DC d.o.o. Each account must be registered and maintained by the person or legal entity that is the actual user of the Platform.
Users are responsible for maintaining the confidentiality and security of their account credentials, including usernames, passwords, authentication tools, and any other access credentials associated with their accounts. Any activity conducted through a user's account shall be deemed to have been authorised by the account holder unless the user promptly notifies AC/DC d.o.o. of unauthorised access, suspected misuse, or security breaches. AC/DC d.o.o. shall not be liable for losses or damages arising from a user's failure to adequately safeguard account credentials.
AC/DC d.o.o. reserves the right to refuse registration, restrict, suspend, or terminate user accounts where registration information is incomplete, inaccurate, misleading, or where the user's activity violates these Terms, applicable law, or exposes the Platform, other users, or third parties to legal, financial, regulatory, reputational, or security risks. Such measures may be implemented without prior notice where required to comply with legal obligations or to protect the integrity, security, or lawful operation of the Platform.
AC/DC d.o.o. reserves the right to implement identity verification, business verification, onboarding compliance procedures, or ongoing monitoring measures where reasonably necessary to comply with regulatory requirements, prevent fraud, ensure marketplace trust, or protect Platform users.
AC/DC d.o.o. further reserves the right to modify, suspend, or discontinue account functionality, access privileges, or Platform features for technical, operational, regulatory, or security reasons. Access to the Platform may be temporarily or permanently restricted where reasonably necessary to maintain Platform stability, integrity, or compliance with applicable law.
Account registration does not create any ownership interest, intellectual property rights, or permanent access rights in relation to the Platform or its services. Continued access to and use of the Platform remains subject to ongoing compliance with these Terms, applicable law, and any additional policies, compliance requirements, or operational rules communicated through the Platform.
Users acknowledge that failure to provide requested verification information may result in account suspension or service restriction.
4. Seller Listings and Product Information
Independent sellers offering products or services through the Platform are solely responsible for the accuracy, completeness, legality, and regulatory compliance of all information provided in their listings. This responsibility includes, without limitation, product descriptions, images, pricing, availability, technical specifications, origin information, licensing details, safety warnings, certification data, compliance documentation, and any other information required under applicable law.
Sellers must ensure that all listings and commercial communications comply with applicable European Union and Slovenian legislation, including laws relating to consumer protection, product safety, product conformity, intellectual property rights, advertising transparency, unfair commercial practices, and any applicable sector-specific regulatory requirements. Listings must not contain false, misleading, deceptive, incomplete, or unlawful information and must accurately reflect the characteristics, condition, intended use, and regulatory status of the products or services offered.
AC/DC d.o.o., acting as the Platform operator, provides the technical infrastructure that enables sellers to publish, manage, and distribute listings but does not verify, endorse, or guarantee the accuracy, legality, quality, safety, conformity, or regulatory compliance of seller-provided content. AC/DC d.o.o. shall not be considered the author, publisher, manufacturer, distributor, or supplier of seller listings within the meaning of applicable law, except where explicitly required under mandatory legal provisions.
Sellers are solely responsible for ensuring that products or services offered through their listings are lawful to market and sell, safe for intended use, and compliant with all mandatory regulatory standards and legal requirements. This responsibility includes obtaining, maintaining, and updating any required certifications, approvals, registrations, conformity assessments, CE markings, authorised representative designations, import compliance documentation, or other regulatory authorisations required under European product safety, market surveillance, consumer protection, or sector-specific legislation.
Where sellers act as manufacturers, importers, authorised representatives, or distributors within the meaning of applicable European product safety or market surveillance legislation, sellers remain solely responsible for fulfilling all legal obligations associated with such roles, including traceability requirements, safety documentation, risk warnings, regulatory reporting, and product recall obligations.
AC/DC d.o.o. reserves the right to request, at any time, documentation, certifications, testing reports, declarations of conformity, intellectual property ownership evidence, safety compliance documentation, or any other regulatory or legal evidence necessary to verify compliance with applicable laws, these Terms, or Platform policies. Failure by a seller to provide such documentation within a reasonable timeframe may result in restriction, suspension, or removal of listings or user accounts.
Sellers must promptly notify AC/DC d.o.o. if any product offered through the Platform becomes subject to safety recall, regulatory investigation, compliance enforcement action, intellectual property dispute, or any circumstance that may render the product unsafe, unlawful, or non-compliant. Sellers remain fully responsible for cooperating with recall procedures, regulatory authorities, customer notifications, corrective actions, and post-sale safety measures required under applicable law.
Sellers represent and warrant that they own or hold valid licences, permissions, or legal rights to use, distribute, advertise, and sell all products, trademarks, content, images, software, or intellectual property included in their listings. Sellers agree to cooperate fully with investigations relating to intellectual property disputes, counterfeit allegations, regulatory complaints, or legal enforcement actions involving their listings.
AC/DC d.o.o. reserves the right, but does not assume an obligation, to review, restrict, remove, disable access to, or suspend listings where there is reasonable suspicion that a listing violates these Terms, applicable law, intellectual property rights, product safety standards, regulatory requirements, or exposes the Platform, users, or third parties to legal, regulatory, or reputational risk. Such measures may be implemented without prior notice where necessary to comply with legal obligations or to maintain the integrity, security, or lawful operation of the Platform.
AC/DC d.o.o. may implement automated or manual compliance monitoring procedures designed to detect unlawful, unsafe, counterfeit, or non-compliant listings in accordance with Regulation (EU) 2022/2065 (Digital Services Act). The implementation of such monitoring measures shall not create a general obligation for AC/DC d.o.o. to monitor user activity or listings beyond obligations imposed under applicable law.
Nothing in this section shall be interpreted as creating liability for AC/DC d.o.o. in relation to seller listings, products, or services or as limiting the responsibility of sellers for compliance with all legal, regulatory, and contractual obligations arising from their use of the Platform.
5. Orders and Contracts
Orders placed through the Platform may relate either to products or services offered by independent third-party sellers or to products or services offered directly by Trasido, as clearly identified in the relevant product listing.
The submission of an order by a buyer through the Platform constitutes an offer to purchase the selected product or service under the terms and conditions presented at the time of checkout. The order shall not be deemed accepted until confirmation of acceptance is issued by the responsible seller or, where applicable, by AC/DC d.o.o. acting as the legal seller.
Automated order confirmations acknowledging receipt of an order are issued for informational purposes only and do not constitute acceptance of the buyer's offer unless explicitly stated otherwise. Acceptance occurs only when the responsible seller dispatches the product, confirms availability for collection, provides confirmed service scheduling, grants access to digital content, or otherwise expressly confirms acceptance of the order.
5.1 Transactions with Independent Sellers
In transactions involving products or services offered by independent sellers, the contract for purchase is concluded exclusively between the buyer and the respective seller. AC/DC d.o.o. does not become a contractual party to such transactions and does not assume liability for the performance of contractual obligations arising between buyers and independent sellers, except where liability arises under mandatory applicable law.
Independent sellers retain the right to accept, reject, or cancel orders where reasonably necessary, including in circumstances involving product unavailability, manifest pricing errors, suspected fraud, payment verification failures, legal restrictions, compliance concerns, or logistical limitations. Sellers shall notify buyers where orders cannot be fulfilled.
AC/DC d.o.o. may facilitate communication between buyers and sellers regarding orders, order status, or dispute reporting but does not assume responsibility for delivery performance, warranty obligations, product conformity, or post-sale disputes arising between buyers and independent sellers. AC/DC d.o.o. does not act as guarantor, escrow agent, or contractual intermediary for such transactions unless explicitly stated.
5.2 Transactions with Trasido (Direct Sales)

AC/DC d.o.o. reserves the right to refuse, decline, or cancel orders prior to acceptance where:
- the product or service is unavailable;
- a manifest pricing or technical error has occurred;
- payment authorisation or verification fails;
- fraud, misuse, or unauthorised activity is reasonably suspected;
- the order violates applicable law, regulatory requirements, or these Terms;
- fulfilment is prevented by logistical or operational limitations.
Where payment has been captured for an order that is subsequently cancelled, AC/DC d.o.o. shall issue refunds in accordance with applicable consumer protection legislation.
AC/DC d.o.o. may impose reasonable quantity limitations, order restrictions, or purchase controls where necessary to prevent abuse, ensure fair product availability, or maintain Platform integrity.
5.3 Digital Products
Where orders concern digital content or electronically supplied services, access to such content may constitute acceptance and fulfilment of the contract. Where required by applicable law, buyers must provide prior express consent to the commencement of digital delivery before the expiry of statutory withdrawal periods and acknowledge that such consent may result in the loss of the right of withdrawal.
Provision of access credentials, activation of digital licences, issuance of download links, or enabling streaming or software access shall constitute delivery and fulfilment of obligations relating to digital products.
5.4 Payment Authorisation and Processing
Orders placed through the Platform are subject to successful payment authorisation through integrated third-party payment service providers. Failure of payment authorisation, verification, or fraud screening procedures may result in automatic cancellation or suspension of the order.
Payment authorisation does not guarantee final payment settlement, and orders may remain subject to verification prior to capture or settlement of funds. Where AC/DC d.o.o. facilitates payment processing on behalf of independent sellers, such facilitation does not establish AC/DC d.o.o. as the seller or contractual counterparty in the transaction unless explicitly stated.
AC/DC d.o.o. reserves the right to implement transaction monitoring procedures, fraud detection mechanisms, payment verification controls, and risk management safeguards in order to comply with financial regulatory obligations and to protect users and the Platform.
5.5 Pricing Errors and Technical Mistakes
In the event of manifest pricing errors, typographical mistakes, technical malfunctions, incorrect product descriptions, or system errors affecting order accuracy, the responsible seller or AC/DC d.o.o., as applicable, reserves the right to cancel or adjust the order prior to acceptance. Buyers shall be notified accordingly and, where payment has been captured, refunds shall be issued without undue delay.
Nothing in this section shall limit mandatory consumer rights under applicable European Union or Slovenian legislation.
5.6 Risk Transfer and Delivery Responsibility
Risk of loss, damage, or deterioration of physical goods shall transfer to the buyer in accordance with applicable consumer protection legislation and the delivery terms communicated during the checkout process. Where products are delivered to consumers, risk shall transfer upon delivery to the buyer or to a third party designated by the buyer, except where otherwise provided under mandatory law.
5.7 Force Majeure Impact on Orders
Order fulfilment, delivery performance, or service availability may be delayed, suspended, or affected by events beyond the reasonable control of AC/DC d.o.o. or independent sellers, including force majeure events as defined elsewhere in these Terms. Neither AC/DC d.o.o. nor independent sellers shall be liable for delays or non-performance resulting from such circumstances, subject to mandatory consumer protection legislation.
6. Physical and Digital Products
The Platform enables the sale and distribution of both physical goods and digital products. The legal framework, delivery methods, contractual obligations, and consumer rights applicable to each category of product or service may differ depending on the nature of the offering and the identity of the responsible supplier.
Products or services offered through the Platform may be supplied either by independent third-party sellers or directly by Trasido, as clearly identified within the relevant product listing. The responsible supplier retains full responsibility for compliance with applicable legal, regulatory, and contractual obligations relating to the products or services offered.
6.1 Physical Products
Physical goods offered through the Platform are supplied either by independent sellers or directly by Trasido, as identified in the relevant listing. Physical products are delivered through postal, courier, freight, or other logistics service providers selected by the responsible supplier.
The responsible supplier shall ensure that physical products comply with all applicable legal requirements, including product safety regulations, product conformity obligations, labelling requirements, certification standards, and sector-specific regulatory rules imposed under applicable European Union and Slovenian legislation, including Directive (EU) 2019/771 concerning contracts for the sale of goods.
Where physical goods are sold directly by Trasido, AC/DC d.o.o. assumes responsibility for ensuring conformity of goods, statutory warranty obligations, delivery performance, and consumer protection compliance in accordance with applicable legislation.
Where physical goods are supplied by independent sellers, such sellers remain solely responsible for product conformity, regulatory compliance, delivery performance, warranty obligations, and post-sale customer support. AC/DC d.o.o. does not verify or guarantee the compliance, safety, quality, or legality of physical products supplied by independent sellers.
6.2 Delivery and Fulfilment of Physical Goods
Delivery obligations, shipping methods, packaging standards, dispatch timelines, and courier selection are determined by the responsible supplier identified in the listing and communicated to the buyer prior to order confirmation.
Delivery timelines displayed on the Platform are estimates only and may be affected by logistics delays, customs inspections, supply chain disruptions, or external service provider performance. AC/DC d.o.o. shall not be liable for delivery delays or losses arising from third-party logistics providers or independent sellers, except where required under mandatory applicable law.
For cross-border deliveries, the responsible supplier shall ensure compliance with applicable export, import, customs, and regulatory requirements. Buyers may be responsible for import duties, customs fees, or local regulatory charges imposed by the destination jurisdiction, unless otherwise stated at checkout.
6.3 Digital Products and Electronically Supplied Services
Digital products offered through the Platform may include downloadable files, software, digital licences, multimedia content, subscription services, or electronically supplied services delivered via digital access mechanisms.
Where digital products are supplied directly by Trasido, AC/DC d.o.o. ensures compliance with Directive (EU) 2019/770 concerning contracts for the supply of digital content and digital services, including obligations relating to functionality, compatibility, interoperability, accessibility, and security of digital content.
Digital content is deemed delivered when access credentials, licence activation, download links, or digital streaming access are provided to the buyer.
Independent sellers offering digital products remain solely responsible for ensuring compliance with applicable digital content legislation, intellectual property requirements, licensing obligations, and technical conformity of digital content supplied through their listings.
6.4 Licensing and Usage Restrictions
Digital products offered through the Platform may be subject to licensing terms governing permitted usage, reproduction, modification, distribution, or resale of digital content.
Buyers are granted limited usage rights in accordance with licensing terms provided prior to purchase. Buyers shall not reproduce, redistribute, resell, publicly distribute, reverse engineer, or otherwise exploit digital content beyond permitted licensing rights.
AC/DC d.o.o. and independent sellers reserve the right to implement reasonable technical protection measures, including authentication controls, licence verification mechanisms, download limitations, digital watermarking, or other technical safeguards designed to prevent unauthorised use or distribution of digital content.
6.5 Technical Compatibility and Buyer Responsibilities
Buyers are responsible for ensuring that their devices, operating systems, software environments, internet connectivity, and technical infrastructure are compatible with the physical or digital products prior to purchase.
The responsible supplier shall provide reasonable pre-contractual information regarding compatibility requirements where required by applicable law. AC/DC d.o.o. shall not be liable for incompatibility issues arising from buyer technical limitations, unsupported devices, or third-party software environments unless such incompatibility results from non-conformity of digital content supplied directly by Trasido.
6.6 Product Updates, Maintenance, and Digital Support
Where applicable, digital products or services may require updates, security patches, or maintenance in order to remain compliant with contractual specifications and applicable legislation.
Where digital content is supplied directly by Trasido, AC/DC d.o.o. shall provide updates necessary to maintain conformity of digital products for the period required under applicable law, taking into account the nature and expected lifespan of the digital product.
Independent sellers remain responsible for providing updates, maintenance, and technical support for digital content offered through their listings unless otherwise stated.
6.7 Withdrawal Rights and Digital Delivery Consent
Where digital products are supplied electronically, buyers acting as consumers may lose the statutory right of withdrawal once digital delivery has commenced, provided that prior express consent has been obtained and recorded in accordance with applicable legislation.
Where digital products are defective, inaccessible, or fail to conform to contractual specifications, buyers may be entitled to remedies provided under applicable consumer protection and digital content legislation.
6.8 Allocation of Product Responsibility
The allocation of responsibility for physical and digital products shall depend on the identity of the responsible supplier identified in the listing. Independent sellers remain solely responsible for their own products and services, including compliance with all legal, regulatory, and contractual obligations.
AC/DC d.o.o. assumes responsibility only for products or services explicitly identified as being supplied directly by Trasido. The operation of the Platform as a marketplace does not create joint liability between AC/DC d.o.o. and independent sellers.
7. Pricing and Payment Processing
Prices for products or services offered through the Platform are determined either by independent third-party sellers or by AC/DC d.o.o. where products or services are offered directly by Trasido, as clearly identified in the relevant product listing.
All prices displayed on the Platform are presented in accordance with applicable consumer protection and pricing transparency legislation and include applicable taxes where required by law, unless expressly stated otherwise.
7.1 Pricing Transparency and Responsibility
All prices displayed on the Platform shall be determined either by independent sellers or, where applicable, by AC/DC d.o.o. in respect of products or services offered directly under the Trasido brand. Prices shall be presented in accordance with applicable European Union and Slovenian consumer protection legislation and shall include all applicable taxes, duties, or mandatory charges where required by law, unless expressly stated otherwise.
Independent sellers shall remain solely responsible for the accuracy, legality, and regulatory compliance of pricing information displayed in their listings, including compliance with tax obligations, currency presentation rules, promotional pricing regulations, and any sector-specific pricing requirements. AC/DC d.o.o. shall not verify or guarantee the accuracy of pricing information provided by independent sellers and shall not be liable for pricing errors, misrepresentations, or regulatory non-compliance arising from seller listings, except where liability cannot be excluded under mandatory applicable law.
Where pricing errors occur, AC/DC d.o.o. and independent sellers reserve the right to cancel or refuse orders affected by manifest or obvious pricing inaccuracies prior to contract confirmation, provided such cancellation is carried out in accordance with applicable consumer protection legislation.
7.2 Payment Processing and Payment Service Providers
The Platform may facilitate payment transactions through integrated third-party payment service providers in order to enable transactions between buyers and sellers. Payment processing services shall be governed by the terms, conditions, and regulatory obligations applicable to the respective payment service provider.
AC/DC d.o.o. shall not act as a licensed financial institution or payment service provider and shall not assume responsibility for payment processing failures, transaction delays, security breaches, service interruptions, or other operational failures arising from third-party payment service providers, except where liability arises directly from AC/DC d.o.o.'s own conduct or cannot be excluded under mandatory applicable law.
Users acknowledge and agree that payment transactions conducted through the Platform may require acceptance of additional contractual terms imposed by payment service providers, financial institutions, or card network operators.
7.3 Merchant of Record and Transaction Structure
Where products or services are sold directly by Trasido, AC/DC d.o.o. shall act as the merchant of record and shall be responsible for payment collection, invoicing, tax compliance, and financial transaction administration in accordance with applicable legislation.
Where products or services are sold by independent sellers, the respective seller shall remain the merchant of record in relation to the underlying commercial transaction, unless otherwise explicitly stated in the product listing or required by applicable law. In such cases, AC/DC d.o.o. may facilitate payment collection as a technical intermediary without becoming a party to the underlying sales contract between buyers and independent sellers.
The facilitation of payment processing by AC/DC d.o.o. shall not be interpreted as creating fiduciary obligations, escrow services, or financial custodianship responsibilities, unless expressly agreed in writing.
7.4 Payment Authorisation and Fraud Prevention
AC/DC d.o.o. reserves the right to implement transaction monitoring, payment verification procedures, identity verification requirements, and fraud prevention measures where reasonably necessary to comply with legal or regulatory obligations, prevent financial abuse, detect suspicious activity, or maintain the security and integrity of Platform transactions.
Where reasonably necessary for fraud prevention or regulatory compliance purposes, AC/DC d.o.o. may suspend, delay, or cancel payment transactions pending verification procedures. Such measures shall be implemented proportionately and in accordance with applicable law.
Users shall cooperate with verification or compliance procedures where requested and shall provide accurate and complete information necessary for payment processing or fraud prevention purposes.
7.5 Payment Settlement and Seller Remittance
Where the Platform facilitates payment processing on behalf of independent sellers, settlement of funds to sellers shall occur in accordance with separate commercial arrangements, payment processing agreements, or seller account terms applicable to independent sellers. AC/DC d.o.o. shall not be liable for delays or withholding of funds resulting from payment provider investigations, fraud prevention measures, regulatory restrictions, or compliance verification procedures.
Independent sellers shall remain solely responsible for taxation, invoicing obligations, accounting compliance, and financial reporting requirements applicable to their commercial activities conducted through the Platform.
7.6 Currency, Exchange Rates, and Transaction Charges
Transactions conducted through the Platform may be processed in various currencies depending on user location, seller configuration, or payment provider requirements. Currency conversion services may be performed by payment service providers, financial institutions, or card network operators, and applicable exchange rates or conversion fees may be determined independently by such providers.
AC/DC d.o.o. shall not be liable for exchange rate fluctuations, currency conversion fees, banking charges, or payment processing fees imposed by third-party payment service providers or financial institutions.
7.7 Chargebacks and Payment Disputes
Where payment disputes, chargebacks, or transaction reversals are initiated by buyers through payment service providers or financial institutions, responsibility for resolving such disputes shall be determined in accordance with the contractual relationship between the buyer and the responsible seller. Independent sellers shall remain responsible for handling chargebacks and payment disputes relating to transactions conducted through their listings.
AC/DC d.o.o. may provide technical support or dispute reporting mechanisms to facilitate resolution processes but shall not be liable for payment disputes arising between buyers, independent sellers, or payment service providers, except where liability arises directly from AC/DC d.o.o.'s own activities or cannot be excluded under mandatory applicable law.
7.8 Platform Fees and Commission Structure
AC/DC d.o.o. may charge fees, commissions, service charges, or subscription fees to independent sellers for the use of Platform services, payment processing infrastructure, marketing tools, or other commercial functionalities. Applicable fee structures shall be communicated to independent sellers through separate seller agreements, Platform policies, or commercial arrangements.
Failure by sellers to comply with payment obligations relating to Platform fees may result in suspension of services, withholding of settlements, or enforcement measures in accordance with applicable contractual arrangements and these Terms.
7.9 No Extension of Financial Liability
Nothing in this Section shall be interpreted as extending financial, payment processing, or transactional liability of AC/DC d.o.o. beyond obligations imposed under applicable law. Independent sellers remain fully responsible for their own financial transactions, regulatory compliance, tax obligations, and payment dispute resolution in connection with transactions conducted through the Platform.
8. Shipping and Delivery
8.1 Responsibility for Shipping and Delivery
Shipping, delivery, and logistics obligations relating to products offered through the Platform shall be determined by the supplier identified in each product or service listing.
Where products are offered by independent third-party sellers, such sellers remain solely responsible for all aspects of shipping and delivery, including packaging, dispatch, courier selection, customs documentation, regulatory compliance, delivery timelines, and post-delivery support. In such cases, the contractual responsibility for delivery performance exists exclusively between the buyer and the independent seller.
AC/DC d.o.o., acting as the Platform operator, provides technological infrastructure enabling shipping arrangements but does not assume responsibility for shipping services performed by independent sellers or third-party logistics providers.
8.2 Shipping Services for Products Sold by Trasido
Where products are offered directly by Trasido, AC/DC d.o.o. assumes responsibility for arranging shipping and delivery in accordance with delivery terms communicated to the buyer prior to the conclusion of the contract.
AC/DC d.o.o. shall ensure that shipping services for products sold directly by Trasido comply with applicable consumer protection legislation, including requirements relating to delivery timeframes, product handling, packaging standards, and statutory risk transfer provisions.
8.3 Delivery Timeframes and Estimates
Delivery timeframes displayed on the Platform represent estimated delivery periods and may vary depending on product availability, seller processing times, courier performance, customs clearance, regulatory inspections, and external logistical conditions.
AC/DC d.o.o. does not guarantee delivery within estimated timeframes for products supplied by independent sellers and shall not be liable for delays caused by sellers, courier services, customs authorities, or external circumstances beyond reasonable control.
Where legally required, AC/DC d.o.o. shall ensure that products sold directly by Trasido are delivered within statutory delivery deadlines applicable under European Union and Slovenian consumer protection legislation.
8.4 Risk Transfer and Delivery Completion
Unless otherwise required by mandatory consumer protection legislation, the risk of loss or damage to products passes to the buyer upon physical delivery of the product to the buyer or to a third party designated by the buyer.
Where products are sold directly by Trasido to consumers within the European Union, risk transfer shall occur in accordance with applicable consumer protection legislation, including Directive 2011/83/EU and Directive (EU) 2019/771, under which risk remains with the seller until the consumer receives physical possession of the goods.
Independent sellers remain solely responsible for risk management relating to products supplied through their listings until delivery is completed in accordance with applicable law.
8.5 Customs, Import Duties, and Cross-Border Shipping
For cross-border shipments, the responsible supplier shall ensure compliance with applicable import, export, customs, and regulatory requirements.
Buyers may be required to pay additional customs duties, import taxes, brokerage fees, or regulatory charges imposed by destination country authorities. Such charges remain the responsibility of the buyer unless explicitly stated otherwise prior to purchase.
AC/DC d.o.o. shall not be liable for customs delays, import restrictions, regulatory seizure of goods, or additional charges imposed by customs authorities in relation to products supplied by independent sellers.
8.6 Courier Services and Third-Party Logistics Providers
Shipping services may be performed by independent courier services, postal operators, freight carriers, or third-party logistics providers. Such service providers operate independently from AC/DC d.o.o. and are governed by their own contractual terms and operational policies.
AC/DC d.o.o. does not control or guarantee the performance, reliability, availability, or conduct of third-party logistics providers and shall not be liable for loss, damage, theft, delay, or delivery failure caused by such providers, except where AC/DC d.o.o. acts as the legal seller and liability arises under mandatory applicable law.
8.7 Tracking, Delivery Notifications, and Communication Tools
The Platform may provide shipment tracking information, delivery notifications, or communication tools designed to assist buyers and sellers in monitoring shipping progress.
Such tools are provided for informational purposes only and do not create contractual obligations or guarantees relating to delivery performance. The availability of tracking information does not modify the allocation of legal responsibility between buyers, sellers, and logistics providers.
8.8 Failed Deliveries and Returned Shipments
Where delivery attempts fail due to incorrect delivery information, buyer unavailability, refusal of shipment, or failure to comply with customs clearance requirements, responsibility for additional shipping costs, storage fees, or return charges shall be determined in accordance with applicable law and the supplier's shipping policy.
Independent sellers remain responsible for resolving delivery failures relating to their listings. Where products are sold directly by Trasido, AC/DC d.o.o. shall manage delivery failure resolution in accordance with applicable consumer protection legislation.
8.9 Shipping Restrictions and Compliance with Regulatory Requirements
Sellers must ensure that products offered through the Platform comply with applicable shipping restrictions, export control regulations, safety transport requirements, and hazardous goods transport laws.
AC/DC d.o.o. reserves the right to restrict or prohibit shipment of products that violate applicable transport regulations, customs requirements, sanctions laws, or Platform policies. Such restrictions may be implemented without prior notice where necessary to comply with legal or regulatory obligations.
9. Returns and Refunds
9.1 General Allocation of Responsibility
The rules governing returns, refunds, and post-sale remedies depend on whether the product or service is offered by an independent third-party seller or directly by Trasido, as clearly identified in the relevant product listing.
Where products or services are supplied by independent sellers, such sellers remain solely responsible for handling returns, issuing refunds, managing complaints, and fulfilling statutory consumer rights arising from their transactions. The contractual relationship concerning returns and refunds exists exclusively between the buyer and the independent seller.
AC/DC d.o.o., acting as the Platform operator, does not assume responsibility for processing returns or issuing refunds in transactions concluded between buyers and independent sellers, except where such responsibility is imposed by mandatory applicable law.
9.2 Returns and Refunds for Products Sold Directly by Trasido
Where products or services are sold directly by Trasido, AC/DC d.o.o. acts as the legal seller and shall process returns and refunds in accordance with applicable European Union and Slovenian consumer protection legislation.
Consumers are generally entitled to exercise the statutory right of withdrawal within fourteen (14) days from:
- the day on which the consumer acquires physical possession of the goods, or
- the conclusion of a service contract,
in accordance with Directive 2011/83/EU on consumer rights and applicable national implementing legislation.
Where the right of withdrawal is validly exercised, AC/DC d.o.o. shall reimburse all payments received from the consumer, including standard delivery costs, without undue delay and no later than fourteen (14) days from the date on which AC/DC d.o.o. is informed of the consumer's decision to withdraw, subject to applicable legal conditions.
AC/DC d.o.o. may withhold reimbursement until returned goods have been received or until the consumer has supplied evidence of having sent back the goods, whichever occurs first, where permitted by applicable law.
9.3 Digital Products and Withdrawal Limitations
Where digital content or electronically supplied services are provided directly by Trasido, the right of withdrawal may not apply where:
- performance has begun with the consumer's prior express consent, and
- the consumer has acknowledged that such consent results in the loss of the right of withdrawal,
in accordance with Directive 2011/83/EU and Directive (EU) 2019/770.
Where digital content is defective or does not conform to contractual specifications, consumers may be entitled to remedies including repair, replacement, price reduction, or contract termination, as provided under applicable digital content legislation.
9.4 Conditions for Returns
Returned products must comply with conditions permitted under applicable law. Consumers may be liable for any diminished value of goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
Independent sellers may establish additional return conditions where legally permissible, provided that such conditions do not restrict mandatory consumer rights under applicable legislation.
9.5 Return Shipping Costs
Responsibility for return shipping costs shall be determined in accordance with applicable law and the relevant return policy applicable to the specific transaction.
Where products are sold directly by Trasido, return shipping costs shall be borne in accordance with applicable consumer protection legislation and the conditions communicated to the buyer prior to contract conclusion.
Where products are sold by independent sellers, return shipping costs shall be governed by the seller's return policy and applicable legal requirements.
9.6 Refund Processing and Payment Reversals
Refunds shall be issued using the same payment method used for the original transaction unless expressly agreed otherwise and where legally permitted.
In transactions involving independent sellers, refund execution remains the responsibility of the seller. AC/DC d.o.o. may, where applicable and technically feasible, facilitate the processing of refunds through integrated payment infrastructure but does not assume liability for refund delays or failures attributable to independent sellers.
AC/DC d.o.o. reserves the right to offset or withhold seller settlement funds where reasonably necessary to cover refunds, chargebacks, payment disputes, fraud losses, or regulatory compliance obligations.
9.7 Defective, Non-Conforming, or Unsafe Products
Where products are defective, unsafe, or fail to conform to contractual requirements:
- Independent sellers remain solely responsible for providing statutory remedies in relation to their products.
- AC/DC d.o.o. assumes responsibility only for products sold directly by Trasido.
The Platform may provide complaint reporting tools to facilitate communication between buyers and sellers. Such tools do not create an obligation for AC/DC d.o.o. to mediate disputes unless required by applicable law.
9.8 Dispute Resolution and Consumer Rights
Nothing in this section limits mandatory consumer rights under applicable European Union or Slovenian law.
Consumers within the European Union may have access to alternative dispute resolution mechanisms or online dispute resolution platforms in accordance with applicable legislation.
10. Intellectual Property
10.1 Ownership of Platform Intellectual Property
All intellectual property rights relating to the Platform, including but not limited to the Platform software, source code, databases, website design, user interfaces, algorithms, documentation, trademarks, service marks, trade names, logos, graphical elements, textual content, images, audiovisual materials, and any other content or materials made available through the Platform, are and shall remain the exclusive property of AC/DC d.o.o. or its licensors. Such intellectual property is protected in accordance with applicable European Union and Slovenian legislation governing copyright, trademarks, database rights, and related intellectual property rights.
Nothing contained in these Terms shall be interpreted as granting or transferring ownership or proprietary rights in the Platform or any part thereof to users, sellers, or third parties.
10.2 Limited Licence to Use the Platform
Users are granted a limited, non-exclusive, non-transferable, and revocable licence to access and use the Platform solely for lawful purposes and strictly in accordance with these Terms.
Without prior written consent of AC/DC d.o.o., users shall not reproduce, distribute, modify, adapt, publicly display, commercially exploit, or otherwise use Platform content beyond authorised Platform use. Users shall further refrain from attempting to reverse engineer, decompile, disassemble, or otherwise derive source code, proprietary algorithms, or technical architecture associated with the Platform, except where such actions are expressly permitted under mandatory applicable law.
Users shall also refrain from removing, altering, or obscuring copyright notices, trademarks, proprietary notices, or other intellectual property markings associated with the Platform or its content.
10.3 Seller Responsibility for Intellectual Property Compliance
Independent sellers are solely responsible for ensuring that all content, products, trademarks, designs, digital materials, images, descriptions, software, and any other materials uploaded, displayed, or offered through their listings do not infringe intellectual property or proprietary rights of third parties.
By publishing listings through the Platform, sellers represent and warrant that they possess all necessary ownership rights, licences, permissions, or authorisations required to lawfully market, distribute, or sell their products or services and that their listings comply with applicable copyright, trademark, design, patent, and licensing laws.
Sellers acknowledge and accept that they remain solely liable for intellectual property infringement claims arising from their listings or commercial activities conducted through the Platform.
10.4 Seller Content Licence to the Platform
By uploading or publishing content through the Platform, sellers grant AC/DC d.o.o. a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, publish, distribute, display, transmit, and technically adapt such content for the purposes of operating, maintaining, promoting, and improving the Platform and its services.
This licence shall remain effective for the duration reasonably necessary to fulfil such operational and promotional purposes, including reasonable archival and backup retention periods following removal of listings. Ownership of seller content shall remain vested in the respective rights holder.
10.5 Intellectual Property Protection and Enforcement
AC/DC d.o.o. respects intellectual property rights and expects all users and sellers to comply with applicable intellectual property laws.
AC/DC d.o.o. reserves the right to restrict, remove, or disable access to listings or content where there is a reasonable suspicion of intellectual property infringement. AC/DC d.o.o. may also suspend or terminate seller accounts associated with repeated infringement, request documentation verifying intellectual property ownership or licensing rights, and cooperate with rights holders, regulatory authorities, or law enforcement agencies where required by law or reasonably necessary to protect Platform integrity.
Such measures may be implemented without prior notice where necessary to comply with legal obligations or to prevent ongoing or repeated infringement.
10.6 Notice-and-Takedown Procedure
The Platform may implement procedures enabling intellectual property rights holders to submit notices alleging infringement of their rights.
Upon receipt of a substantiated infringement notice, AC/DC d.o.o. may restrict or remove allegedly infringing content, notify the affected seller, request counter-notification or supporting documentation, and implement additional enforcement measures where required under applicable law. AC/DC d.o.o. acts as a neutral technical intermediary and does not adjudicate intellectual property disputes between sellers and rights holders except where required by mandatory legal provisions.
10.7 Digital Content Protection and Technical Measures
AC/DC d.o.o. reserves the right to implement reasonable technical protection measures designed to prevent unauthorised reproduction, redistribution, resale, or misuse of digital content offered through the Platform. Such protection measures may include authentication systems, licensing verification mechanisms, access control technologies, or other technical safeguards consistent with applicable law and industry standards.
Users shall not attempt to circumvent, disable, interfere with, or otherwise undermine such protection mechanisms.
10.8 User Generated Content
Where users submit reviews, comments, feedback, or other user-generated content through the Platform, users grant AC/DC d.o.o. a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, and display such content for purposes related to the operation, promotion, and improvement of the Platform.
Users remain solely responsible for ensuring that submitted content does not violate intellectual property rights, privacy rights, or applicable legal requirements.
10.9 Limitation of Platform Liability
AC/DC d.o.o. operates the Platform as a neutral hosting and technical intermediary and shall not be liable for intellectual property infringements committed by independent sellers or users, except where liability arises under mandatory applicable law.
11. Prohibited Use and Platform Conduct
Users are required to use the Platform in compliance with these Terms, applicable laws, and generally accepted standards of lawful and responsible commercial conduct. The Platform may not be used for any activity that is unlawful, fraudulent, misleading, harmful, or that may negatively affect other users, third parties, or the integrity, security, or reputation of the Platform.
Users must not offer, publish, distribute, or otherwise make available any products, services, or content that violate applicable legal or regulatory requirements. This includes, without limitation, the sale, promotion, or distribution of counterfeit goods, stolen goods, illegal digital content, unsafe or uncertified products, prohibited substances, or products that require regulatory authorisation that has not been obtained.
Users are prohibited from engaging in fraudulent or deceptive commercial practices, including providing false or misleading product information, manipulating product reviews or ratings, engaging in payment fraud, impersonating individuals or businesses, or misrepresenting identity, product origin, or commercial status. Users must not artificially influence product visibility, search rankings, or platform metrics through automated systems, coordinated behaviour, or deceptive marketing techniques.
Users must not interfere with or attempt to disrupt the proper functioning of the Platform. This includes attempting to gain unauthorised access to Platform systems, bypass security mechanisms, introduce malicious software, conduct data scraping without authorisation, exploit technical vulnerabilities, or use automated bots or similar technologies to extract or manipulate Platform data.
Users must not misuse Platform communication tools, including sending spam, harassment, misleading commercial communications, or unlawful marketing content. All commercial communications conducted through the Platform must comply with applicable advertising and consumer protection legislation.
Independent sellers must ensure that their commercial activity complies with all applicable legal obligations, including consumer protection laws, product safety regulations, intellectual property rights, taxation requirements, licensing obligations, and export or import regulations applicable to the products or services they offer.
AC/DC d.o.o. reserves the right to investigate suspected violations of these Terms and to take appropriate enforcement measures where reasonably necessary to protect users, ensure regulatory compliance, or maintain the integrity and security of the Platform. Such measures may include removal of listings or content, restriction of Platform functionality, suspension or termination of user accounts, cancellation of transactions, or reporting unlawful activity to competent authorities, where required by applicable law.
The implementation of enforcement measures shall not create an obligation for AC/DC d.o.o. to monitor user activity continuously and shall not create liability for user conduct beyond obligations imposed under applicable law.
12. Platform Monitoring and Content Removal
12.1 Neutral Intermediary Status
AC/DC d.o.o. operates the Platform as a digital marketplace and technical intermediary that enables users and independent sellers to offer, publish, and distribute content, products, and services. In accordance with applicable European Union legislation, including Regulation (EU) 2022/2065 (Digital Services Act), AC/DC d.o.o. does not assume a general obligation to monitor user activity, listings, communications, or transactions conducted through the Platform.
The operation of the Platform shall not be interpreted as establishing editorial control, approval authority, or supervisory responsibility over user-generated content, except to the extent required by applicable law.
12.2 Right to Monitor and Investigate
Notwithstanding the absence of a general monitoring obligation, AC/DC d.o.o. reserves the right to monitor, review, investigate, and analyse content, listings, communications, or user activity where reasonably necessary to ensure compliance with these Terms, applicable law, regulatory obligations, or Platform security requirements.
Such monitoring activities may be carried out for purposes including the prevention of unlawful content, intellectual property infringements, fraud, consumer protection violations, safety risks, or misuse of Platform services. Monitoring measures shall be implemented proportionately and in accordance with applicable data protection and privacy legislation.
12.3 Removal or Restriction of Content
AC/DC d.o.o. reserves the right to remove, restrict, suspend, disable access to, or otherwise limit visibility of content, listings, user accounts, or transactions where it reasonably determines that such content or activity may violate these Terms, applicable law, intellectual property rights, product safety requirements, consumer protection rules, or regulatory obligations.
Content or listings may also be removed or restricted where AC/DC d.o.o. determines that such material poses a risk to Platform integrity, user safety, commercial reliability, or legal compliance. Such enforcement measures may be implemented without prior notice where immediate action is necessary to prevent harm, comply with legal obligations, or mitigate regulatory or security risks.
12.4 Notice and Action Procedures
The Platform may implement procedures allowing users, rights holders, regulatory authorities, or other third parties to submit notifications alleging unlawful content, intellectual property infringements, or regulatory violations. AC/DC d.o.o. shall assess such notifications in accordance with applicable notice-and-action obligations under the Digital Services Act and other applicable legislation.
Where a notification is considered sufficiently substantiated, AC/DC d.o.o. may take appropriate enforcement measures, including restricting or removing content, suspending transactions, requesting supporting documentation, or limiting user access to Platform services. AC/DC d.o.o. may, where appropriate and legally permissible, inform affected users of enforcement actions and provide an opportunity to respond or submit counter-notifications.
12.5 Proportional Enforcement and Repeat Violations
Enforcement measures shall be implemented in a proportionate manner taking into account the severity, frequency, and potential impact of the violation. AC/DC d.o.o. reserves the right to impose progressively restrictive enforcement measures, including temporary suspension, listing removal, transaction limitations, or permanent termination of Platform access in cases involving repeated, systematic, or serious violations of these Terms or applicable law.
Users shall cooperate fully with investigation procedures, provide accurate and complete information when requested, and comply with enforcement measures implemented under this Section.
12.6 Regulatory Cooperation
AC/DC d.o.o. may cooperate with competent regulatory authorities, law enforcement agencies, consumer protection authorities, intellectual property rights holders, and other legally authorised entities in connection with investigations relating to unlawful content, regulatory compliance, fraud prevention, or public safety obligations.
Where required by applicable law, AC/DC d.o.o. may disclose user information, suspend access to Platform services, or remove content in order to comply with legal orders, regulatory directives, or lawful authority requests.
12.7 No Platform Liability for User Content
AC/DC d.o.o. shall not be liable for content, listings, products, or services made available by independent sellers or users through the Platform. Responsibility for the legality, accuracy, safety, compliance, and intellectual property status of such content remains solely with the respective user or independent seller who provided such material.
The implementation of monitoring measures, enforcement procedures, or content removal actions shall not be interpreted as creating an obligation for AC/DC d.o.o. to monitor user activity on an ongoing basis, nor shall such actions be interpreted as establishing liability for user-generated content, except where liability arises under mandatory applicable law.
12.8 Platform Integrity and Risk Prevention
AC/DC d.o.o. may implement automated or manual risk detection systems, content moderation tools, compliance verification procedures, and safety monitoring mechanisms designed to maintain Platform integrity, prevent unlawful activity, and protect users and third parties. Such systems may include algorithmic detection tools, behavioural monitoring processes, or manual review procedures where reasonably necessary to ensure lawful and safe operation of the Platform.
12.9 No Extension of Liability
Nothing in this Section shall be interpreted as extending the legal responsibility or liability of AC/DC d.o.o. beyond obligations imposed under applicable European Union or Slovenian legislation. Independent sellers and users remain fully responsible for their own content, listings, communications, and commercial activities conducted through the Platform.
13. Limitation of Liability
13.1 Platform Availability and Technical Operation
AC/DC d.o.o. provides the Platform and all related services on an "as available" and "as is" basis. AC/DC d.o.o. undertakes commercially reasonable efforts to maintain the availability, functionality, performance, and security of the Platform. However, AC/DC d.o.o. does not warrant or guarantee uninterrupted availability, continuous system access, error-free performance, or the absence of service interruptions, delays, cyber incidents, system failures, maintenance downtime, or technical defects.
Users acknowledge that the Platform relies on complex technological infrastructure, third-party integrations, telecommunications networks, and internet-based systems that are inherently subject to operational limitations and risks beyond the reasonable control of AC/DC d.o.o.
13.2 Marketplace Intermediary Liability Exclusion
Where transactions are conducted between buyers and independent third-party sellers through the Platform, AC/DC d.o.o. acts solely and exclusively as a digital intermediary providing technological infrastructure, communication tools, and transactional functionality that enable users to engage in commercial interactions.
Unless expressly identified otherwise within a specific product or service listing, AC/DC d.o.o. shall not be deemed to act as the seller, distributor, supplier, manufacturer, importer, reseller, agent, or contractual counterparty in relation to transactions concluded between buyers and independent sellers. The contractual relationship governing the sale, delivery, licensing, or provision of products or services listed by independent sellers shall arise exclusively between the buyer and the respective seller.
To the fullest extent permitted under applicable European Union and Slovenian legislation, AC/DC d.o.o. shall not assume responsibility or liability for the legality, regulatory compliance, safety, conformity, authenticity, performance, quality, availability, or suitability of products or services offered by independent sellers, nor for the accuracy, completeness, or reliability of information, descriptions, specifications, or representations contained within seller listings.
AC/DC d.o.o. shall further not be liable for the performance, fulfilment, or execution of contractual obligations undertaken by buyers or independent sellers, including obligations relating to delivery performance, logistics execution, product warranties, after-sales services, regulatory compliance, taxation obligations, licensing rights, or consumer protection requirements applicable to seller activities.
Users acknowledge and agree that AC/DC d.o.o. does not verify, monitor, endorse, certify, or guarantee the conduct, performance, reliability, or commercial capability of independent sellers, and that reliance upon seller listings, seller communications, or seller representations is undertaken at the user's own commercial risk.
AC/DC d.o.o. shall not be liable for losses or damages arising from acts, omissions, misrepresentations, breaches of contract, unlawful conduct, or regulatory violations committed by independent sellers or buyers, except where liability arises directly from the acts or omissions of AC/DC d.o.o. or where such liability cannot be excluded under mandatory applicable law.
All claims, disputes, or legal proceedings arising from or relating to transactions conducted between buyers and independent sellers shall be directed exclusively between the contracting parties to such transactions. Nothing in this Section shall be interpreted as creating agency, partnership, joint liability, or joint commercial responsibility between AC/DC d.o.o. and independent sellers.
Nothing in this Section shall exclude or limit mandatory consumer rights or statutory protections that cannot be waived or restricted under applicable law.
13.3 Safe Harbour and Hosting Immunity
AC/DC d.o.o. operates the Platform as a hosting and intermediary service provider in accordance with Regulation (EU) 2022/2065 (Digital Services Act) and applicable European e-commerce legislation.
AC/DC d.o.o. does not assume a general obligation to monitor user-generated content, seller listings, communications, or transactions conducted through the Platform.
Liability for unlawful content, illegal products, or regulatory violations created or distributed by users shall arise only where AC/DC d.o.o. has obtained actual knowledge of unlawful activity and has failed to act expeditiously to remove or disable access to such content in accordance with applicable law.
Nothing in these Terms shall be interpreted as creating proactive monitoring obligations beyond those required under applicable law.
13.4 Third-Party Service Dependency Limitation
The Platform relies on third-party service providers including payment service providers, hosting infrastructure providers, logistics providers, telecommunications operators, cloud service providers, authentication services, and technical integration partners.
AC/DC d.o.o. shall not be liable for service interruptions, payment failures, delivery disruptions, infrastructure outages, data loss, or security incidents arising from third-party service providers, provided that AC/DC d.o.o. has exercised reasonable diligence in selecting and maintaining such providers.
Users acknowledge that use of integrated third-party services is subject to the respective contractual terms of such providers.
13.5 Cybersecurity and Account Security Liability Allocation
AC/DC d.o.o. implements appropriate technical and organisational measures designed to protect Platform integrity and user data in accordance with applicable legal requirements and industry standards.
AC/DC d.o.o. shall not be liable for losses arising from unauthorised account access, credential misuse, identity theft, fraudulent transactions, or cybersecurity incidents where such incidents occur despite the implementation of reasonable security safeguards or arise from user negligence, compromised credentials, or third-party security failures.
Users remain responsible for maintaining the confidentiality and security of their authentication credentials.
13.6 Exclusion of Indirect, Consequential and Economic Damages
To the fullest extent permitted under applicable European Union and Slovenian legislation, AC/DC d.o.o. shall not be liable for any indirect, incidental, consequential, punitive, exemplary, aggravated, or special damages arising out of or in connection with access to, use of, inability to use, reliance upon, or interaction with the Platform or any content, products, or services made available through the Platform.
Such exclusion shall apply regardless of whether such damages are characterised as foreseeable, foreseeable but avoidable, reasonably contemplated, indirectly resulting, commercially linked, or otherwise consequential in nature. The exclusion shall extend to, without limitation, any loss of business, revenue, turnover, profit, anticipated savings, commercial opportunity, goodwill, reputation, digital assets, data, customer relationships, contractual expectations, supply chain continuity, operational capacity, or business continuity.
The exclusion further applies to any damages arising from technological dependencies, system integrations, third-party infrastructure failures, cyber incidents, transaction disruptions, or performance failures of independent sellers, payment service providers, logistics providers, hosting infrastructure, telecommunications networks, cloud service operators, or other external systems beyond the direct operational control of AC/DC d.o.o.
This limitation shall apply irrespective of the legal basis of the claim, including but not limited to claims arising in contract, tort, negligence, misrepresentation, statutory liability, strict liability, product liability, breach of warranty, breach of duty, economic loss doctrine, or any other legal or equitable theory, even where AC/DC d.o.o. has been advised of the possibility of such damages or where such damages were reasonably foreseeable at the time of contract formation.
Users expressly acknowledge that the Platform operates as a digital marketplace infrastructure and not as a guarantor of commercial outcomes, transactional success, or business performance. Users further acknowledge that marketplace participation inherently involves commercial risk, third-party reliance, technological dependencies, and operational uncertainties that are beyond the reasonable control of AC/DC d.o.o., and that such risks form part of the economic basis upon which Platform services are made available.
Nothing in this Section shall exclude or limit liability where such exclusion or limitation would be unlawful under mandatory applicable law, including statutory consumer protection provisions or liability for death or personal injury caused by intentional misconduct or gross negligence.
Nothing in this Section shall be interpreted as extending liability of AC/DC d.o.o. beyond that which is expressly required under mandatory applicable legislation.
13.7 Aggregate Liability Cap
Where liability of AC/DC d.o.o. cannot be excluded under mandatory applicable law, including cases involving gross negligence or intentional misconduct, the total aggregate liability of AC/DC d.o.o. arising from or related to the Platform shall, to the maximum extent permitted by law, be limited to the total amount of fees paid by the user to AC/DC d.o.o. during the twelve (12) months preceding the event giving rise to the claim.
Where users have not paid fees directly to AC/DC d.o.o., liability shall be limited to the minimum legally permitted threshold under applicable law.
13.8 Risk Allocation and Commercial Basis
Users expressly acknowledge that the allocation of liability and risk contained in this Section constitutes a fundamental and material element of the contractual relationship between users and AC/DC d.o.o. and reflects the commercial and operational nature of the Platform as a digital marketplace infrastructure provider.
Users further acknowledge that Platform services are made available in reliance upon the limitations of liability set out herein.
13.9 Mandatory Consumer Protection Safeguard
Nothing in this Section shall exclude or limit liability where such exclusion or limitation would be unlawful under mandatory European Union or Slovenian legislation.
In particular, nothing in this Section shall limit liability for death or personal injury caused by intentional misconduct or gross negligence, nor shall it limit mandatory consumer rights under applicable consumer protection legislation.
13.10 Jurisdictional Severability of Liability Limitations
Where liability limitations contained in this Section are deemed invalid or unenforceable under the mandatory law of a specific jurisdiction, such limitation shall be enforced to the maximum extent permitted under that jurisdiction, and the remaining provisions of this Section shall remain valid and enforceable.
14. Indemnification
Users agree to indemnify, defend, and hold harmless AC/DC d.o.o., its directors, officers, employees, affiliates, contractors, partners, and service providers from and against any and all claims, demands, actions, proceedings, damages, losses, liabilities, penalties, fines, costs, and expenses, including reasonable legal and professional fees, arising out of or in connection with the user's access to, use of, or activities conducted through the Platform.
This indemnification obligation includes, without limitation, claims arising from the user's breach of these Terms, violation of applicable laws or regulations, infringement of intellectual property rights or other proprietary rights of third parties, submission of unlawful or misleading listings or content, provision of defective, unsafe, or non-compliant products or services, misuse of Platform functionality, or failure to fulfil contractual or statutory obligations owed to buyers or other users.
Independent sellers expressly agree to indemnify and hold harmless AC/DC d.o.o. from and against any claims, complaints, enforcement actions, regulatory proceedings, or legal disputes brought by buyers, rights holders, governmental authorities, or third parties arising from or relating to transactions conducted through their listings. Such indemnification shall include claims relating to product safety, product conformity, delivery failures, warranty claims, consumer protection violations, licensing and intellectual property disputes, taxation obligations, customs compliance, or any regulatory non-compliance associated with seller activities.
The indemnification obligation shall apply regardless of whether the claim arises during the seller's active use of the Platform or following suspension or termination of the seller's account, provided that the claim relates to activities conducted through the Platform.
Where AC/DC d.o.o. provides products or services directly under the Trasido brand, the indemnification obligations set out in this section shall not apply to claims arising solely from AC/DC d.o.o.'s own acts or omissions in its capacity as the legal seller or service provider, except to the extent permitted under applicable law.
AC/DC d.o.o. reserves the right, at its own discretion and expense, to assume exclusive control of the defence or settlement of any claim subject to indemnification under this section. Users agree to provide full cooperation, assistance, and access to relevant documentation or information reasonably required for the defence of such claims. Users shall not settle or compromise any claim that imposes liability or obligations upon AC/DC d.o.o. without the prior written consent of AC/DC d.o.o.
Nothing in this section shall limit or exclude any rights or remedies available to AC/DC d.o.o. under applicable law, including the right to seek injunctive relief, damages, or reimbursement of losses resulting from user conduct.
15. Suspension and Termination
15.1 Right of Suspension or Termination
AC/DC d.o.o. shall be entitled, at its sole and reasonable discretion and without prejudice to any other rights or remedies available under applicable law or these Terms, to suspend, restrict, limit, or permanently terminate a user's access to the Platform, including but not limited to user accounts, listings, transactional capabilities, payment functionality, or specific Platform services, where AC/DC d.o.o. reasonably determines that:
- (a) the user has breached or is likely to breach these Terms;
- (b) the user has violated or is reasonably suspected of violating applicable laws or regulatory requirements;
- (c) the user has engaged in conduct that may expose the Platform, other users, third parties, or regulatory authorities to legal, financial, operational, security, or reputational risk;
- (d) continued access would compromise the integrity, security, lawful operation, or regulatory compliance status of the Platform; or
- (e) enforcement action is required to comply with internal risk management, fraud prevention, or compliance monitoring procedures.
AC/DC d.o.o. reserves the right to apply proportionate enforcement measures based on the severity, frequency, and nature of the violation.
15.2 Grounds for Enforcement
Without limitation, enforcement measures may be implemented where user activity involves or is reasonably suspected of involving:
- (a) fraudulent conduct, payment abuse, or financial irregularities;
- (b) unlawful, misleading, unsafe, or non-compliant product listings or services;
- (c) infringement or suspected infringement of intellectual property rights or proprietary rights of third parties;
- (d) repeated substantiated consumer complaints or regulatory reports indicating non-compliance with consumer protection or product safety obligations;
- (e) submission of false, incomplete, or misleading identity, business, or product information;
- (f) misuse, manipulation, or attempted circumvention of Platform systems, technical infrastructure, security mechanisms, or compliance controls;
- (g) failure or refusal to cooperate in compliance verification, audit procedures, or investigation processes conducted by AC/DC d.o.o.; or
- (h) systematic or repeated violations of Platform policies or applicable legal obligations.
Users engaging in repeated or systematic violations may be subject to permanent termination of Platform access and removal of associated listings, accounts, or services without reinstatement, where reasonably necessary to protect the Platform, users, or regulatory compliance.
15.3 Regulatory and Risk-Based Suspension
AC/DC d.o.o. may suspend, restrict, or terminate access to the Platform where required or reasonably requested by competent authorities, regulatory bodies, payment service providers, financial institutions, insurance providers, or internal compliance and risk management procedures.
Such enforcement measures may be implemented where necessary to prevent fraud, money laundering, terrorist financing, regulatory violations, intellectual property infringement, product safety risks, or other unlawful or high-risk activities.
AC/DC d.o.o. may also suspend or delay transactions pending compliance verification, identity verification, documentation review, or investigation of suspicious activity.
15.4 Notice and Proportionality
Where reasonably practicable and not prohibited by applicable law, AC/DC d.o.o. shall provide notice to the affected user specifying the principal grounds for suspension or termination and, where appropriate, provide an opportunity to remedy the violation within a reasonable timeframe.
Users subject to investigation or enforcement action shall cooperate fully with AC/DC d.o.o. and provide accurate, complete, and timely information or documentation reasonably requested during compliance or investigation procedures.
Notwithstanding the foregoing, AC/DC d.o.o. reserves the right to implement immediate suspension or termination without prior notice where such action is reasonably necessary to:
- (a) comply with legal or regulatory obligations;
- (b) prevent imminent harm, fraud, or unlawful activity;
- (c) preserve Platform security, operational integrity, or user safety;
- (d) prevent evidence destruction or circumvention of enforcement measures; or
- (e) mitigate material financial, operational, or reputational risk.
15.5 Effects of Suspension or Termination
Suspension or termination of Platform access shall not affect rights, obligations, or liabilities accrued prior to such enforcement action, including but not limited to payment obligations, indemnification obligations, dispute resolution obligations, data retention obligations, and liability arising from transactions concluded prior to suspension or termination.
AC/DC d.o.o. may retain, process, or disclose information where necessary to:
- (a) comply with legal, regulatory, or audit obligations;
- (b) enforce these Terms;
- (c) resolve disputes or investigate violations;
- (d) prevent fraud or security threats; or
- (e) cooperate with competent authorities,
in accordance with applicable data protection legislation.
AC/DC d.o.o. shall not be obliged to restore suspended or terminated accounts, listings, or content unless required under applicable law.
15.6 Voluntary Termination by Users
Users may terminate their use of the Platform at any time by discontinuing access and, where applicable, requesting account closure in accordance with Platform procedures.
AC/DC d.o.o. may impose reasonable administrative, verification, security, or compliance requirements to ensure lawful, secure, and properly documented account closure and settlement of outstanding obligations.
15.7 No Obligation to Maintain Access
Nothing in this Section shall be interpreted as creating any obligation on the part of AC/DC d.o.o. to maintain user accounts, listings, services, or Platform access for any minimum duration. AC/DC d.o.o. reserves the right to modify, discontinue, or restrict Platform services where reasonably necessary for operational, regulatory, security, or commercial reasons.
16. Data Protection
16.1 General Principles of Processing
AC/DC d.o.o. processes personal data in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation – "GDPR"), applicable Slovenian data protection legislation, Directive 2002/58/EC (ePrivacy Directive), and other applicable European Union laws governing the protection of personal data and electronic communications.
Personal data shall be processed lawfully, fairly, and transparently, solely for specified, explicit, and legitimate purposes, and only to the extent necessary for the operation of the Platform, the performance of contractual obligations, compliance with legal or regulatory obligations, protection of legitimate business interests, or where valid consent has been obtained.
AC/DC d.o.o. applies the principles of data minimisation, storage limitation, integrity, confidentiality, and accountability in accordance with Article 5 GDPR.
16.2 Allocation of Roles – Controller and Processor
The allocation of data protection responsibilities depends on the nature of the transaction conducted through the Platform.
Where products or services are offered directly by Trasido, AC/DC d.o.o. acts as the data controller within the meaning of Article 4(7) GDPR in respect of personal data processed in connection with such transactions.
Where products or services are offered by independent sellers, such sellers act as independent and separate data controllers within the meaning of Article 4(7) GDPR with respect to personal data processed for the purposes of order fulfilment, delivery, customer communication, warranty obligations, regulatory compliance, and after-sales services.
The use of the Platform by independent sellers does not create joint controllership between AC/DC d.o.o. and independent sellers unless expressly agreed in writing in accordance with Article 26 GDPR.
In certain limited circumstances, AC/DC d.o.o. may act as a data processor within the meaning of Article 4(8) GDPR on behalf of independent sellers where personal data processing is carried out strictly in accordance with documented instructions and subject to appropriate data processing agreements where required under Article 28 GDPR.
Independent sellers remain solely responsible for ensuring compliance with applicable data protection obligations in relation to personal data processed in connection with their commercial activities conducted through the Platform, including ensuring lawful collection, lawful processing, data accuracy, transparency obligations, and data subject rights compliance.
16.3 Categories of Data and Purposes of Processing
Personal data processed through the Platform may include identification data, contact information, transaction and payment data, delivery and order-related data, customer communication records, technical usage data, and compliance or verification documentation.
Such personal data may be processed for the purposes of account registration and authentication, order processing and transaction management, payment processing and fraud prevention, customer support and dispute resolution, compliance with legal and regulatory obligations, enforcement of contractual rights, security monitoring and risk prevention, as well as the development, optimisation, and improvement of Platform services.
Further details regarding processing purposes, legal bases, and retention periods are set out in the Privacy Notice, which forms an integral part of these Terms.
16.4 Legal Bases for Processing
Personal data shall be processed on one or more legal bases provided under Article 6 GDPR. Such legal bases may include processing necessary for the performance of a contract or pre-contractual measures, compliance with legal or regulatory obligations, legitimate interests pursued by AC/DC d.o.o., including fraud prevention, Platform security, risk management, and service optimisation, provided that such interests are not overridden by fundamental rights and freedoms of data subjects, and consent where required by applicable law.
Where special categories of personal data are processed, such processing shall occur only in accordance with Article 9 GDPR and applicable national legislation and only where a valid legal basis exists.
16.5 Data Transfers
Where personal data is transferred outside the European Economic Area, such transfers shall be carried out exclusively in accordance with Chapter V GDPR and applicable international data transfer safeguards. Such safeguards may include reliance on adequacy decisions adopted by the European Commission, the implementation of Standard Contractual Clauses, the application of Binding Corporate Rules, or other lawful transfer mechanisms recognised under applicable legislation.
Independent sellers remain solely responsible for ensuring lawful cross-border transfers of personal data under their control.
16.6 Security Measures
AC/DC d.o.o. implements appropriate technical and organisational measures in accordance with Article 32 GDPR to ensure a level of security appropriate to the risks associated with personal data processing. Such measures are designed to protect personal data against unauthorised access, loss, destruction, alteration, or unlawful processing and may include encryption, pseudonymisation, access control systems, network security safeguards, monitoring and incident detection procedures, and data retention control policies.
AC/DC d.o.o. may monitor Platform activity and user interactions where reasonably necessary to detect fraud, security incidents, regulatory violations, or misuse of Platform services.
16.7 Data Subject Rights
AC/DC d.o.o. maintains procedures designed to detect, assess, and respond to personal data breaches in accordance with Articles 33 and 34 GDPR. Independent sellers shall promptly notify AC/DC d.o.o. of any personal data breach affecting Platform users where such breach relates to transactions conducted through the Platform and shall cooperate fully in investigation, notification, and mitigation procedures.
Each party remains responsible for breach notification and regulatory reporting obligations applicable to its role as controller or processor under applicable law.
16.8 Data Retention
Data subjects may exercise their rights under Articles 15 to 22 GDPR, including rights of access, rectification, erasure, restriction of processing, data portability, objection to processing, and withdrawal of consent where applicable.
Requests relating to personal data processed by AC/DC d.o.o. may be submitted in accordance with procedures described in the Privacy Notice. Where personal data is processed by independent sellers acting as separate controllers, data subject requests must be addressed directly to the relevant seller. AC/DC d.o.o. shall not be liable for failures by independent sellers to comply with data subject rights obligations.
16.9 No Extension of Liability
AC/DC d.o.o. may implement automated decision-making or profiling mechanisms where reasonably necessary for fraud prevention, security monitoring, risk assessment, and optimisation of Platform functionality. Where automated decision-making produces legal or similarly significant effects on users, such processing shall be conducted in accordance with Article 22 GDPR and applicable legal safeguards.
16.10 Data Retention
Personal data shall be retained only for as long as necessary to fulfil the purposes for which it was collected, to comply with legal or regulatory obligations, resolve disputes, enforce contractual rights, maintain audit trails, or prevent fraud or abuse. Retention periods shall be determined in accordance with applicable legislation, regulatory requirements, and internal compliance policies.
16.11 Seller Compliance and Indemnification
Independent sellers represent and warrant that they shall process personal data in full compliance with GDPR and all applicable data protection legislation. Independent sellers agree to indemnify and hold harmless AC/DC d.o.o. against claims, damages, regulatory penalties, or losses arising from seller non-compliance with data protection obligations.
16.12 No Extension of Liability
Nothing in this Section shall be interpreted as extending the data protection responsibilities or liabilities of AC/DC d.o.o. beyond those imposed under applicable data protection legislation. Independent sellers remain fully responsible for their own data processing activities conducted through the Platform.
17. Third-Party Services
17.1 Use of Third-Party Services
The Platform may integrate, rely upon, or provide access to services, infrastructure, or functionalities operated by third-party providers, including but not limited to payment processing services, hosting infrastructure, logistics and delivery services, communication tools, authentication services, analytics systems, cybersecurity services, and other technical or operational service providers necessary for the functioning of the Platform.
The use of such third-party services is intended solely to facilitate the operation, security, performance, and efficiency of the Platform.
17.2 Independent Operation of Third-Party Providers
Third-party service providers operate independently from AC/DC d.o.o. and are governed by their own contractual terms, privacy policies, and regulatory obligations. By using the Platform, users acknowledge and agree that certain Platform functionalities may require interaction with or reliance upon third-party services.
Users agree to comply with all applicable terms and conditions governing such third-party services where such services are used in connection with the Platform.
17.3 Limitation of Responsibility for Third-Party Services
To the maximum extent permitted by applicable law, AC/DC d.o.o. shall not be responsible or liable for the availability, performance, security, reliability, or compliance of third-party services, nor for any acts, omissions, failures, or breaches committed by such third-party providers.
Any disputes, claims, losses, or damages arising from the use of third-party services shall be resolved directly between the user and the relevant third-party service provider, unless liability of AC/DC d.o.o. arises from its own intentional misconduct or gross negligence, where such limitation is permitted under applicable law.
17.4 Modification or Replacement of Third-Party Services
AC/DC d.o.o. reserves the right to modify, replace, suspend, or discontinue integrations with third-party services where reasonably necessary for operational, security, regulatory, compliance, or commercial reasons.
Such modifications may result in changes to Platform functionality, payment methods, delivery options, or service availability, and users acknowledge that such changes do not constitute a breach of these Terms.
17.5 Data Processing by Third-Party Providers
Where third-party service providers process personal data in connection with Platform services, such processing shall be carried out in accordance with applicable data protection legislation and contractual safeguards implemented by AC/DC d.o.o.
Users acknowledge that third-party providers may process personal data as independent data controllers or data processors, depending on the nature of the service provided.

17.6 No Partnership or Agency Relationship
The integration or use of third-party services shall not create any partnership, joint venture, agency, or employment relationship between AC/DC d.o.o. and the respective third-party provider, nor shall it transfer legal responsibility for the third-party provider's services to AC/DC d.o.o.
17.7 Preservation of Mandatory User Rights
Nothing in this Section shall limit or exclude any mandatory rights of users under applicable consumer protection or data protection legislation.
18. Governing Law and Jurisdiction
18.1 Applicable Law
These Terms, together with any contractual or non-contractual obligations arising out of or in connection with access to, use of, or reliance upon the Platform, including transactions conducted through the Platform, shall be governed by and construed in accordance with the laws of the Republic of Slovenia, taking into account directly applicable European Union legislation.
The application of Slovenian law shall include legislation governing electronic commerce, digital services, consumer protection, contractual obligations, and commercial transactions, to the extent applicable to Platform operations and user interactions.
18.2 Consumer Protection Safeguards
Where users qualify as consumers within the meaning of applicable European Union consumer protection legislation, the choice of Slovenian law shall not deprive such consumers of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence, in accordance with Regulation (EC) No 593/2008 on the law applicable to contractual obligations (Rome I Regulation).
Nothing in these Terms shall be interpreted as restricting or excluding mandatory statutory consumer rights which cannot lawfully be waived or limited under applicable European Union or national consumer protection legislation.
18.3 Jurisdiction for Consumer Users
Subject to Regulation (EU) No 1215/2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (Brussels I Recast Regulation), consumers may bring proceedings against AC/DC d.o.o. before the competent courts of the Member State in which they are domiciled or before the competent courts of the Republic of Slovenia.
AC/DC d.o.o. reserves the right to initiate proceedings against consumer users only before the courts of the Member State in which the consumer is domiciled, except where applicable law provides otherwise.
18.4 Jurisdiction for Business Users
Users acting in the course of business, trade, or professional activity expressly agree that any disputes, claims, or proceedings arising out of or relating to these Terms, the operation of the Platform, or transactions conducted through the Platform shall fall within the exclusive jurisdiction of the competent courts of the Republic of Slovenia.
Business users expressly waive, to the fullest extent permitted by applicable law, any objections relating to jurisdiction, venue, forum non conveniens, or similar procedural objections.
18.5 Disputes Between Buyers and Independent Sellers
Users acknowledge that contractual disputes arising from transactions conducted between buyers and independent sellers shall primarily be resolved between the contracting parties to such transactions.
Nothing in this Section shall be interpreted as establishing AC/DC d.o.o. as a party to disputes arising between buyers and independent sellers, except where liability arises directly from AC/DC d.o.o.'s own activities or where intervention is required under mandatory applicable law.
18.6 Right to Seek Interim or Protective Measures
Nothing in this Section shall restrict or limit the right of AC/DC d.o.o. to seek interim, protective, or injunctive relief before any competent court or regulatory authority where such relief is reasonably necessary to protect intellectual property rights, confidential information, regulatory compliance interests, Platform integrity, or cybersecurity interests.
18.7 Severability of Jurisdiction Provisions
If any provision relating to jurisdiction or applicable law contained in this Section is determined by a competent authority or court to be invalid, unlawful, or unenforceable under mandatory applicable law, such provision shall be interpreted and enforced to the maximum extent permitted, and the remaining provisions shall remain valid and enforceable.
19. Dispute Resolution
19.1 Purpose and Scope
This Section establishes the procedures governing the resolution of disputes, claims, or disagreements arising out of or in connection with access to, use of, or reliance upon the Platform, including disputes relating to transactions conducted through the Platform, contractual obligations, user conduct, or enforcement of these Terms.
The dispute resolution framework set out in this Section is intended to promote efficient, fair, and proportionate resolution of disputes while minimising unnecessary litigation.
19.2 Informal Resolution Procedure
Before initiating formal legal proceedings, users agree to make reasonable efforts to resolve disputes informally.
Users shall submit written notice of any dispute to AC/DC d.o.o. via the contact channels specified on the Platform, providing sufficient detail regarding the nature of the dispute, relevant transactions, and the relief sought.
AC/DC d.o.o. shall review the dispute and may request additional information, documentation, or clarification where reasonably necessary to assess the matter. The parties shall use reasonable efforts to resolve the dispute through good-faith negotiations within a reasonable timeframe following submission of the dispute notice.
Nothing in this provision shall limit mandatory statutory consumer rights or restrict users from initiating proceedings where informal resolution is unsuccessful or where immediate legal action is required under applicable law.
19.3 Mediation Procedure
Where informal negotiations fail to resolve a dispute, the parties may agree to submit the dispute to mediation conducted by a neutral and independent mediator.
Mediation shall be conducted in accordance with recognised mediation rules applicable within the European Union or the Republic of Slovenia, unless otherwise agreed between the parties.
Participation in mediation shall not prejudice the rights of either party to pursue arbitration or judicial proceedings if mediation fails to resolve the dispute.
19.4 Arbitration for Business Users
Where disputes arise between AC/DC d.o.o. and users acting in the course of business, trade, or professional activity, such disputes may be referred to binding arbitration where permitted by applicable law and agreed between the parties.
Unless otherwise agreed in writing, arbitration proceedings shall be conducted under recognised arbitration rules applicable within the European Union. The arbitration tribunal shall consist of one or more arbitrators appointed in accordance with applicable arbitration rules.
The seat of arbitration shall be located within the Republic of Slovenia, unless otherwise agreed by the parties. Arbitration proceedings shall be conducted in the English language, unless the parties agree otherwise.
The arbitration award shall be final and binding upon the parties and may be enforced in any competent jurisdiction in accordance with applicable international enforcement rules.
19.5 Consumer Dispute Resolution and ODR Compliance
Where disputes involve users acting as consumers within the European Union, consumers retain the right to access alternative dispute resolution mechanisms in accordance with Directive 2013/11/EU on alternative dispute resolution for consumer disputes.
Consumers may submit disputes through the European Commission Online Dispute Resolution platform, available at: https://ec.europa.eu/consumers/odr
AC/DC d.o.o. shall cooperate with competent alternative dispute resolution bodies where required under applicable law. Nothing in this Section shall restrict or limit the statutory rights of consumers to initiate judicial proceedings before competent courts.
19.6 Disputes Between Buyers and Independent Sellers
Users acknowledge that disputes arising from transactions conducted between buyers and independent third-party sellers shall primarily be resolved directly between the contracting parties to such transactions.
AC/DC d.o.o. may provide communication tools, dispute reporting interfaces, or support mechanisms designed to facilitate communication between users. Such tools are provided solely to support dispute management and shall not be interpreted as establishing AC/DC d.o.o. as a party to such disputes or as assuming responsibility for dispute resolution, except where required under applicable law.
19.7 Escalation and Internal Review
AC/DC d.o.o. reserves the right to implement internal review procedures designed to assess disputes involving potential violations of these Terms, unlawful content, fraudulent activity, or regulatory compliance concerns.
Such internal review procedures may include temporary suspension of transactions, restriction of user accounts, or preservation of evidence where reasonably necessary to protect Platform integrity, users, or third parties.
Internal dispute review shall not constitute arbitration, mediation, or judicial adjudication and shall not limit the rights of parties to pursue formal dispute resolution procedures.
19.8 Allocation of Dispute Resolution Costs
Unless otherwise determined by applicable law, arbitration rules, mediation agreements, or competent judicial authority, each party shall bear its own legal, administrative, and professional costs associated with dispute resolution.
Nothing in this provision shall restrict the right of a competent authority, arbitrator, or court to allocate costs in accordance with applicable procedural rules.
19.9 Class Action and Collective Proceedings Limitation
To the fullest extent permitted by applicable law, disputes between users and AC/DC d.o.o. shall be resolved on an individual basis.
Users agree not to participate in collective, consolidated, representative, or class action proceedings against AC/DC d.o.o., except where such limitation is prohibited under mandatory applicable law.
19.10 Preservation of Statutory Rights
Nothing in this Section shall limit, exclude, or waive rights which cannot lawfully be limited or excluded under applicable European Union or Slovenian legislation, including mandatory consumer protection rights.
19.11 Interim and Protective Measures
Nothing in this Section shall prevent AC/DC d.o.o. from seeking interim, protective, or injunctive relief before competent courts or regulatory authorities where reasonably necessary to protect intellectual property rights, confidential information, cybersecurity interests, Platform integrity, or regulatory compliance.
20. Account Closure and Effect of Termination
20.1 Voluntary Account Closure
Users may request closure of their account at any time by submitting a request through the Platform or by contacting customer support in accordance with Platform procedures. Account closure shall become effective once the request has been processed and verified by AC/DC d.o.o.
AC/DC d.o.o. reserves the right to implement reasonable administrative, technical, or verification requirements to ensure lawful and secure account closure, including verification of user identity and confirmation that no outstanding obligations remain.
20.2 Outstanding Transactions and Obligations
Account closure shall not affect transactions that were initiated prior to the closure request. Users remain responsible for fulfilling all obligations arising from transactions concluded before account closure, including but not limited to delivery obligations, payment obligations, warranty obligations, refund obligations, dispute resolution procedures, and compliance with applicable consumer protection legislation.
AC/DC d.o.o. may delay account closure where reasonably necessary to allow completion of pending transactions, resolution of disputes, or compliance with legal or regulatory requirements.
20.3 Data Retention Following Account Closure
Following account closure, AC/DC d.o.o. may retain certain information where necessary to comply with legal obligations, regulatory requirements, dispute resolution procedures, fraud prevention measures, enforcement of contractual rights, or record-keeping obligations under applicable law.
Personal data shall be retained only for the duration required by applicable data protection legislation and internal compliance policies and shall thereafter be securely deleted or anonymised.
20.4 Effect of Termination or Suspension
Termination or suspension of a user account, whether voluntary or initiated by AC/DC d.o.o., shall not affect rights, obligations, or liabilities accrued prior to such termination or suspension. This includes, without limitation:
- (a) payment obligations;
- (b) indemnification obligations;
- (c) intellectual property licence obligations;
- (d) dispute resolution obligations;
- (e) compliance with legal or regulatory requirements.
20.5 Seller-Specific Consequences
Where an independent seller account is terminated or closed, the seller shall immediately cease listing products or services through the Platform and shall not represent themselves as authorised or affiliated with Trasido.
AC/DC d.o.o. may remove or disable access to seller listings following termination and may retain records of seller activity where required for regulatory compliance, dispute resolution, or fraud prevention.
20.6 Platform Discretion and Protection of Integrity
AC/DC d.o.o. reserves the right to restrict or refuse re-registration of users where reasonably necessary to protect Platform integrity, prevent fraud, ensure compliance with legal obligations, or mitigate operational or reputational risk.
20.7 Survival of Certain Provisions
Provisions of these Terms which by their nature are intended to survive termination or account closure shall remain in full force and effect following termination. Such provisions include, without limitation, provisions relating to liability, indemnification, intellectual property rights, data protection, dispute resolution, and governing law.
21. Amendments to Terms
21.1 Right to Amend
AC/DC d.o.o. reserves the right to amend, update, supplement, or replace these Terms where reasonably necessary to reflect changes in applicable law, regulatory requirements, technological developments, security standards, commercial practices, risk management procedures, or the functionality and structure of the Platform.
Amendments may also be introduced where necessary to address legal, operational, or compliance risks, to improve Platform services, or to reflect modifications to the commercial model under which the Platform operates.
21.2 Publication and Effective Date
Updated versions of these Terms shall be published on the Platform together with a revised effective date. Unless otherwise specified, amended Terms shall enter into force upon publication on the Platform.
Users are responsible for periodically reviewing the Terms to remain informed of any updates or modifications.
21.3 Material Changes
Where amendments materially affect user rights or obligations, AC/DC d.o.o. shall provide reasonable prior notice through the Platform interface, electronic communication, or other appropriate communication channels, where such notification is required under applicable law or reasonably necessary to ensure transparency.
Material changes may include, but are not limited to, modifications relating to liability allocation, dispute resolution procedures, payment processing arrangements, or core Platform functionality.
21.4 Continued Use as Acceptance
Subject to mandatory legal requirements, continued access to or use of the Platform following the effective date of amended Terms shall constitute acceptance of such amendments.
Where applicable legislation requires explicit user consent for specific amendments, AC/DC d.o.o. shall implement appropriate mechanisms to obtain such consent prior to applying the amended Terms.
21.5 Non-Retroactivity
Users who do not agree with amended Terms may discontinue use of the Platform and, where applicable, request account closure in accordance with Platform procedures prior to the effective date of the amended Terms.
Termination of Platform use shall not affect rights or obligations accrued prior to termination.
21.6 Immediate Changes for Compliance or Security
Unless required by applicable law or expressly agreed between the parties, amendments to these Terms shall not apply retroactively to transactions concluded prior to the effective date of such amendments.
21.7 Immediate Amendments for Legal or Security Reasons
Notwithstanding the foregoing, AC/DC d.o.o. reserves the right to implement amendments with immediate effect where reasonably necessary to:
- a) comply with mandatory legal or regulatory obligations
- b) respond to cybersecurity threats or security vulnerabilities
- c) prevent fraud, unlawful activity, or misuse of the Platform
- d) address risks that may materially affect Platform users or third parties
Where reasonably practicable, AC/DC d.o.o. shall inform users of such immediate amendments without undue delay.
22. Final Provisions
22.1 Entire Agreement
These Terms, together with the Privacy Notice, Cookies Policy, Returns Policy, Refund Policy, Shipping Policy, Seller Agreement, and any additional policies, guidelines, or contractual documents expressly incorporated by reference, constitute the entire agreement between users and AC/DC d.o.o. concerning access to and use of the Platform.
These Terms supersede and replace all prior agreements, negotiations, representations, communications, or understandings, whether written or oral, relating to the subject matter herein.
22.2 Severability
If any provision of these Terms is held to be invalid, unlawful, or unenforceable by a competent court or regulatory authority, such provision shall be interpreted and enforced to the maximum extent permitted by applicable law so as to reflect the original intent of the provision.
The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.
22.3 Assignment and Transfer of Rights
Users may not assign, transfer, sublicense, or otherwise delegate any of their rights or obligations under these Terms without the prior written consent of AC/DC d.o.o.
AC/DC d.o.o. reserves the right to assign, transfer, subcontract, or otherwise delegate its rights and obligations under these Terms to affiliated entities, successor entities, or third parties, including in connection with corporate restructuring, mergers, acquisitions, asset transfers, investment transactions, or changes in business ownership, provided that such transfer does not reduce user rights under mandatory applicable law.
22.4 Waiver of Rights
Failure or delay by AC/DC d.o.o. in exercising any right, remedy, or provision under these Terms shall not constitute a waiver of such right or remedy and shall not prevent AC/DC d.o.o. from exercising such rights at a later time.
Any waiver of rights by AC/DC d.o.o. shall be effective only if expressly stated in writing and shall apply solely to the specific circumstances for which it is granted.
22.5 Survival of Provisions
Any provisions of these Terms which by their nature are intended to survive termination or expiration of Platform use shall remain in force following termination or suspension of user access. Such provisions include, without limitation, provisions relating to liability limitations, indemnification, intellectual property, dispute resolution, governing law, data protection, and enforcement rights.
22.6 No Partnership or Agency
Nothing contained in these Terms shall be interpreted as creating a partnership, joint venture, agency relationship, employment relationship, or fiduciary relationship between AC/DC d.o.o. and any user, seller, or third party, except where expressly provided by applicable law or a separate written agreement.
22.7 Language and Interpretation
These Terms are drafted in the English language. Where translations are made available for convenience, the English version shall prevail in the event of inconsistencies, unless mandatory applicable law requires otherwise.
Headings and section titles are included for convenience only and shall not affect the interpretation of these Terms.
22.8 Compliance with Mandatory Law
Nothing in these Terms shall exclude, limit, or modify any rights or obligations that cannot be lawfully excluded or limited under applicable European Union or Slovenian legislation, including mandatory consumer protection, data protection, and regulatory compliance provisions.
22.9 Electronic Communication and Contract Formation
Users agree that communications, notices, contractual confirmations, and other information exchanged through electronic means via the Platform shall satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law.
